Federal Court Orders Freedom of Abrego Garcia from Immigration Detention
A federal judge has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement lacks legal authority.
"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.
The case stems from a erroneous removal to El Salvador in March, which the government later admitted was an mistake. After his return to the United States to face alien smuggling charges, he was held in federal detention.
In her decision, the court pointed out that the government lacks a valid removal order, which prevents them from removing Mr. Abrego Garcia "for now."
Background of the Case
The legal proceedings center on disputed assertions. While the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this claim.
He has also pleaded not guilty to the conspiracy counts, which are part of a separate criminal case in the state of Tennessee.
Conditions of Release
The judge, who was hearing his challenge to removal in a Maryland district court, determined that he must now adhere to the terms of his release from custody in Tennessee. This decision effectively transfers his monitoring to the jurisdiction handling his criminal case.
This decision marks a notable turn in a complicated immigration battle involving claims of wrongful detention and contested gang associations.
